If Disney hadn't been so concerned about some poor little kid being traumatized FOREVER for seeing a pair of boobs, then it would have made complete sense for Ursula to appear topless. (And BTW, I'm not just talking about all the mermaids in that movie either, since having bras underwater makes no sense anyways.)

Since she was cast out and rejected by society, it would have made sense for Ursula to make her 'customers' as uncomfortable and on-edge as possible so as to have them make bad deals. No reason to hide, be ashamed, or fit into society's rules- all things that would instead have made her customers uneasy even more-so than the stories about her and her appearance and magic. So to be topless all the time would have been completely within the realm of her personality.
